Federal Judge Rules Pa. Gay Marriage Ban Is Unconstitutional

6717dd40aff7601637bd9c3062cb83a1The ban on gay marriage in Pennsylvania was struck down by a U.S. District Court in Pennsylvania which nullified Pennsylvania’s Marriage Laws, holding that they violate the due process and equal protection clauses of the 14th Amendment to the U.S. Constitution. If the ruling stands up on appeal, it would give same-sex couples the right to marry in Pennsylvania and require Pennsylvania to recognize same-sex marriages that have validly been performed elsewhere. Many counties are allowing same sex couples to apply for marriage licenses today.

This is the fourth time in recent weeks that a federal court has overturned a state law banning same-sex marriage, following decisions in Idaho, Arkansas, and Oregon.
